Buyer & Seller Tip of the Month

Yay or Nay? New Sedona Vacation Rental Law

Signed by the Governor earlier this year, SB 1350 will take effect on January 1st, 2017 – the allowance of vacation rentals, state wide. So, what does it mean?

  • Cities, towns and counties can no longer restrict the use of short-term/vacation rentals.
  • Provides a mechanism to collect rental taxes and remit to the AZ Department of Revenue.
  • Creates more economic opportunity and inclusiveness, while protecting the private property rights of homeowners.
  • CC&Rs of subdivision(s) WILL SUPERSEDE this ruling. If your subdivision’s CC&Rs have language restricting the length of rental periods, you must still abide by those timeframes.

So the question becomes, can a subdivision make changes to their CC&Rs to prohibit vacation rentals? The answer is yes, by a supermajority vote of homeowners (67% or higher is typically needed). Read below to see what this means for you as a Buyer of Sedona Real Estate & a current Sedona Resident.

New Vacation Rental Law – What this means for you as a buyer in Sedona?

  • Better opportunities for you to earn income on a piece of Sedona Property while you are not using it.
  • We expect property taxes to increase for those who vacation rent (short-term lease) their Sedona Home.
  • As stated above, there will be additional taxes + fees to be collected from your proceeds per stay.
  • CC&Rs will supersede this ruling, therefore when beginning your search for Sedona Real Estate, be sure to connect with an experienced Sedona Realtor to help you research which subdivisions have minimum rental periods. Keep in mind that the CC&Rs may be amended at any time – it is our advice to be cautious when purchasing a Sedona Home solely for the purpose of vacation renting it.

Disclaimer: The city of Sedona may try to appeal this ruling. If they do, the effective January 1st date may be postponed. It is our advice to be cautious when purchasing a Sedona Property for the sole purpose of vacation renting it. Long term rentals can also be a lucrative form of passive income.

New Vacation Rental Law – What this means for you as a Sedona Homeowner?

Is your Sedona Property a second home/investment property? For those of you who are interested in vacation renting your property, now is the time to prepare for January 1st by researching your CC&Rs and setting up systems. If you live out of town, we recommend finding a reliable cleaning service, handyman, and/or a Sedona Property Manager to make the operation run smoothly.

Fulltime Sedona Residents – This ruling is a good thing for income properties; however, as a fulltime Sedona resident, you may not want the increase of traffic to your neighborhood. Look below for what to do if you DO NOT want your neighbors’ vacation renting their home(s).

  • Be active in your HOA Meetings – At this time, the only thing that can supersede this ruling is the restriction of short-term rentals within your CC&Rs. You can be active in the process and suggest an amendment to the CC&Rs via the voting process.
  • Move – Excuse our bluntness, but if your Subdivision is not willing to amend the CC&R’s via a supermajority vote, then one option may be to sell and move to a Sedona Subdivision with minimum rental requirements.
  • Take a ‘wait & see’ approach - Be happy that your property owner’s rights are protected and you maintain the ability and flexibility to decide who occupies your property.

Recipe of the Month

Grilled Shrimp with Roasted Garlic-Cilantro Sauce

Serves 4 | Prep Time: 15 Mins | Cook Time: 16 Mins

Ingredients

  • 1.5 lb uncooked prawns
  • Salt and pepper
  • Olive oil
    Roasted garlic-cilantro sauce:
  • 1 small head garlic, top trimmed off
  • 1 cup chopped fresh cilantro leaves
  • 1 lime, juice of
  • 1 tbsp dry white wine
  • 3 tbsp olive oil
  • 2 tbsp chili sauce (or 1 tbsp dry chili flakes)
Grilled Shrimp with Roasted Garlic-Cilantro Sauce

Directions

  • Preheat your oven to 400 degrees F.
  • Peel, devein and rinse the prawns or your choice of shrimp. Pat dry and season with salt and pepper. Place the prawns in the fridge until ready to grill.
  • Trim the top of the garlic head off, but leave the garlic intact. Drizzle generously with olive oil. Roast the garlic in the 400 degree F-heated oven for about 10-15 minutes or until slightly tender and fragrant. When ready, remove from the oven. Let cool briefly. Peel and crush or chop the roasted garlic as finely as possible.
  • Now prepare the roasted garlic-cilantro sauce. In a small bowl, combine the roasted garlic with the remaining sauce ingredients of cilantro, lime juice, white wine, olive oil and chili sauce. Whisk together and set aside.
  • When ready, lightly oil and heat a cast-iron grill or griddle to medium-high. Dress the prawns with a little olive oil and grill for 3-4 minutes on each side. You want to achieve some char, but be careful not to overcook the prawns.
  • Remove the prawns from the grill to a bowl and coat well with the roasted garlic and cilantro sauce. Transfer to a serving platter. Alternatively, transfer the grilled prawns to a serving platter and simply add the roasted garlic-cilantro sauce on the side.
  • Serve with pasta or rice and a green salad for dinner; or simply as a party appetizer. Enjoy!
