Purchasing a Sedona Home with a Contingent Offer

Every so often life does not go as planned. Sometimes you end up finding a new Sedona Home that you fall in love with before you have sold your current residence. That is no problem at all. We can always make an offer that is contingent on your current property selling back home. Occasionally we deal with this obstacle and we make what is called "a Contingent Offer."

Take a look at the following items to keep in mind when considering making a Contingent Offer:

  1. All Contingent Offers are not equal. In Arizona, there are two stages that can occur when using a Contingent Offer as a strategy. The first option occurs when your home is not currently listed for sale. You make the offer based on a series of dates that your current home will be listed and that you will obtain a contract by a predetermined date. Then you also make a decision as to what would be the latest date that your new home would close escrow. Upon that closing, you will be able close your new Sedona home purchase.
  2. The second scenario entails you making an offer on the new home while your current residence is also currently under contract. This strategy is much more of a sure thing and can be seen as a smaller obstacle than the previous option. At this stage, you are only waiting for your current property to close to provide you with the funds for your new purchase.

Here are a few obstacles to be aware of when writing a contingent offer:

  • You do not receive a contract by your predetermined date. In this case, you may still decide to purchase the property if you are able to fund/finance the purchase with alternative means. Last case option, would be the seller agreeing to extend the length of escrow to allow for the closing of your current home.
  • Your current property does not appraise – therefore you do not have enough funds to close your future purchase. Same as above, you will either need to obtain other funds or cancel the contract and look for alternative Sedona properties within your new budget.
  • The buyers for your current residence cannot close on time. In this scenario, communication is key and with the help of seasoned Realtors, your deal can be preserved if the delay is within reason.
  • In a multiple offer situation, contingent offers typically lose out to cash buyers. One way around this is to entice the sellers with a favorable offer terms. One thought would be to put down substantial earnest monies or to offer above asking price – remember, only do this if you must have this special Sedona Home.

Our last thought with contingent offer strategy is to try to prevent becoming emotionally attached to the property prior to having your contingency(s) met. Prepare to Part

"Prepare to Part", these can be tough words to hear when you’re discussing your home and belongings. That is why we want to prepare you prior to listing your Sedona Home. Therefore, you are not caught off guard when it's time to pack and move.

The standard Arizona Real Estate Purchase Contract states that fixtures are to be included in the sale of the property, as well as any person property that is added/addressed in the contract. Generally speaking you can determine a fixture vs. personal property by the way it is attached to the residence.

A fixture is permanently attached, whereas personal property is not. One good example of this is the kitchen appliances. The range is a fixture (built into the cabinets) and transfers with the property. The refrigerator is a stand-alone appliance, therefore it is considered personal property, and it must be written into the contract if it is to be sold with the Sedona Home.

Below is a quick list of predetermined fixtures. These are items that you will have to part with unless explicitly excluded from the sale in writing. Keep in mind that this list is not all-inclusive – be sure to ask your Sedona Realtor about any items you are unsure about.

Although there is a space on the contract for additional personal property to be included in the sale, items such as furniture, artwork, etc. should be addressed in a separate bill of sale. One reason we suggest selling these items separately is because when the buyer has to obtain a loan, the lender loans funds for real property and cannot establish an appropriate value of personal property.

We’ve seen many deals affected by this rookie mistake when a loan is involved. The buyer has difficulties obtaining the loan for the agreed upon purchase price (because the appraisal only addresses real property, as mentioned above) and the deal falls apart. Recipe of the Month

Chili Lime Chicken

Serves 4 | Prep Time: 15 Mins | Marinate: 2 hrs | Cook Time: 10 Mins

Ingredients

  • 2 – 2.5 lbs skin on chicken thighs
  • 1/2 cup fresh lime juice
  • 3 teaspoons fresh lime zest
  • 1/4 cup olive oil
  • 4 tablespoons fresh cilantro, chopped finely
  • 2 jalapeño, chopped finely
  • 4 garlic cloves, chopped finely
  • 1 tablespoon honey
  • 2 teaspoons salt
  • 1 teaspoon chili powder or to taste
Chili Lime Chicken

Directions

  • Rinse the chicken thighs, remove the bones, leave the skin on, and pat dry with paper towels. Set aside.
  • Get a big bowl, mixing all the ingredients of the Marinade together using a whisk. Make sure the Marinade is well combined together.
  • Add chicken to the Marinade, make sure to stir and coat the chicken evenly. Marinate for 2 hours.
  • Fire up the grill, brush a little bit of oil on the surface. Add a little bit of the garlic, cilantro, and jalapeno from the Marinade on top of the chicken and grill them until they turn golden brown and charred on both sides. Serve immediately.
  • Cook’s Note: You can make this chili lime chicken with a cast-iron grill pan or regular skillet, or bake in the oven. Preheat the oven to 400F and bake it for about 20-25 minutes or until the skin becomes brown and charred. You can also use skinless and boneless chicken thighs or breasts.
