Why you Should Review a Survey

When purchasing a piece of Sedona Real Estate, it is important to investigate all aspects of your future property. Arizona is a due diligence state, meaning the buyer is responsible for investigating all things of value to them. Just as you would inspect the quality of the home, you should also verify the amount of land you are purchasing. We recommend verifying all corners of the premises via a current Property Boundary Survey.

Knowing where the property corners are is a must when moving forward to purchase a Sedona Property. It is important to understand how much land you are responsible for from a maintenance and liability standpoint. It will also help determine if the fence you are looking at is on the property line or if you are in danger of extra expenses due to the encroachment on a neighbor’s border.

Understanding what land accompanies the purchase is extremely important and should be addressed during the inspection period. We have lived in the area for quite some time and can help direct you to a competent surveyor if need be. If a recent survey has been performed on the property, attempt to review the report rather than ignore the fact due to the extra expense.

When a Survey is Most Important?

For Sedona Properties not in a Subdivision/HOA - Most Subdivisions have plat maps that accompany visually identifiable lot lines. We normally encourage our clients to get a survey, but in a Sedona Subdivision – most clients do not see the need for the extra expense. However, when a Sedona Property is not located in a subdivision, we strongly suggest getting a survey, or a copy of a recent survey, to decipher where the boundaries of your property will be.

Let us give an example from one of our past clients. The MLS description of the property was 4.5+ acres. Once we reviewed a recent survey of the property, we realized the property was approx. half of an acre short of the description (only 4.25 acres).

Understanding what was being conveyed was extremely important for the buyer due to their future plans. Knowing the discrepancy prior to the end of the inspection period allowed for the buyer to negotiate a discount due to the lesser amount of Sedona Real Estate being sold. If the survey wasn’t reviewed, or a survey wasn’t performed, the buyer would have no recourse against the seller because of Arizona’s Due Diligence requirement.

Ending to the story, our client (the buyer) reduced their offer and purchased the property for fair market value. The survey allowed them to understand what they were buying and avoid heartache down the road. Seller's Property Disclosure Statement

When in Doubt - Disclose!

Arizona law requires all Sellers to disclose facts about their property that may affect a Buyer's decision to purchase. The Arizona Department of Real Estate has created a form that asks a variety of questions to prod the Seller's memory. The form is called the Seller's Property Disclosure Statement (SPDS). The process of filling out the form can be time consuming, but we suggest that Sellers complete the form as soon as possible after their Sedona Property is listed for sale. This way there is no immediate deadline for the form to be completed and you can be thorough in your disclosure.

Once a contract is accepted on the Sedona Property, the Seller has five (5) days to provide the Disclosure Statement to the potential Buyer. If the SPDS form has already been completed, the Seller may only be required to update the form prior to delivering a copy.

What Should We Put on the Form?

The best piece of advice we can give our clients, and it says it on the form --

Recipe of the Month

Chicken Piccata

Ingredients

  • Olive oil cooking spray
  • 8 boneless, skinless, thin-cut chicken cutlets (2 lbs)
  • 3/4 tsp salt
  • 1/4 tsp freshly ground black pepper
  • 1 1/2 cups fat-free reduced-sodium chicken broth
  • 4 tsp. arrowroot or cornstarch, dissolved in 2 tsp. water
  • 1 tsp. chopped fresh rosemary
  • 4 thin lemon slices
  • 3 tbsp. drained nonpareil capers
  • 1 tbsp. unsalted butter
Chicken Piccata

Directions

  • Generously coat a 12-in ovenproof skillet with cooking spray. Season chicken with salt and pepper on both sides.
  • Heat pan over high heat. Cook 2 or 3 cutlets at a time until lightly browned 2 minutes per side. Transfer to a plate and cover with foil to keep warm. Repeat with remaining chicken, coating pan with cooking spray between batches.
  • Add chicken broth and bring to a simmer, 1 to 2 minutes. Add the dissolved arrowroot or cornstarch and whisk until thickened 2 to 3 minutes. Return chicken to the pan with rosemary, lemon slices and capers: gently simmer until chicken is cooked through, 2 to 3 minutes. Remove chicken from pan and divide among 4 plates.
  • Add butter to sauce in pan and cook over high heat until slightly thickened, 1 to 2 minutes. Spoon about 1/3 cup sauce over each plate. Enjoy.
